There is almost no one who wants the government to determine how our estate is divided after we die. With that as a caveat, it is amazing that many people do not have a will to ensure their estate is disposed of as they wish. A will is a legal document that does several things.

  • It names someone who will be the person in charge of managing the disposition of your estate. This person can be a relative, close friend, attorney, or someone else
  • It lets you specify if you have minor children who will be their guardian
  • It is how you let the courts know how you want your money and belongings to be divided up when you have passed on.

Without a will the court uses a formula to dispose of your money, real property, and personal property, and having an attorney assist is the best means to assure your wishes are well-documented and can be legally executed.

A trust holds money or other assets for the benefit of a person or entity. When the assets are placed in a trust, a trustee is appointed who will be responsible for ensuring that the assets are distributed to the child in the manner and time that the parent has stipulated. Trusts are not only used to protect assets designated for minor children and adult children with extraordinary expenses, such as medical expenses.

Trusts are a vehicle used for protecting assets and for tax purposes. Tax considerations are an integral part of estate planning as they impact strategies used in wills and trusts for the structure and execution of assets to be disseminated to heirs and other beneficiaries.
